What is a guardianship and how do I know that one is needed?

Guardianship is a proceeding initiated when an individual is no longer able to provide for his or her basic needs such as food, clothing and shelter; when that person is no longer able to manage his or her health, property and financial affairs, whether due to a mental condition, brain injury, or due to an illness such as dementia or Alzheimer’s.

Fatima Breland of The Breland Law Firm, P.C., has been helping families cope with the loss of capacity of loved ones by walking them through the process of establishing guardianships.

Fatima Breland educates her clients regarding the complexity of initiating a guardianship and the court requirements once it is established, she arranges an initial comprehensive conference with prospect clients in order to map the road to guardianship, exposing families to the court requirements in a guardianship, to the duties of a guardian, and to explain the role of court appointed attorneys, i.e., attorney ad litem, and guardian ad litem, if necessary.

The role of the attorney ad litem is to represent the interest of the person to be under guardianship, and to ensure that less restrictive alternatives to guardianship have been considered. Occasionally it is necessary for the court to appoint a guardian ad litem. The guardian ad litem investigates the circumstances surrounding the application, the applicant, the less restrictive alternatives to guardianship considered, and reports to the court regarding the best interests of the person to be under guardianship.

The guardianship path begins with the application process, continues through the establishment of a guardianship and compliance with the court requirements such as filing of the inventory and annual reports. Fatima Breland will be with you each step of the way as you serve as fiduciary.
